Terms of Service
The rules governing use of Fangrandia's server and infrastructure services, with a focus on acceptable use and abuse prevention.
This document is available in English and Traditional Chinese. In the event of any inconsistency between the two versions, the English version shall prevail.
1. Introduction & Scope
These Terms of Service ("Terms") govern your access to and use of Fangrandia Limited's ("Fangrandia", "we", "us", or "our") dedicated server, IaaS, and related infrastructure services (the "Services"). By ordering, activating, or using the Services, you ("Customer" or "you") agree to these Terms, including the Acceptable Use Policy in Section 4. Where a signed service agreement or order form exists between you and us, these Terms apply in addition to it, and the signed agreement prevails in the event of conflict.
The Services are unmanaged unless we agree otherwise in writing (meaning you are responsible for the operation, configuration, security, and maintenance of your operating system, software, and applications); development work such as system or software development requires a separate agreement in addition to these Terms. Engagements for system development or web design alone, without the Services, are not covered by these Terms and will be agreed separately. These Terms also do not apply to our web media properties (e.g., Saiga NAK, Technow), which are governed by their own published terms.
2. Eligibility & Client Verification
The Services are available to corporate entities only. We do not enter into service agreements with individuals.
We may decline to contract with, or may suspend or terminate service to, any entity whose legal existence, business substance, or good standing we reasonably doubt. Where we consider it necessary, we may request supporting documentation — such as a Certificate of Incorporation, corporate statements or filings, or utility bills — to verify your identity and corporate standing, whether before entering into an agreement or at any time during the provision of the Services.
3. Your Account & Responsibility for Use
You are responsible for all activity that takes place on or through your server(s), including activity by your own customers, end users, employees, or any third party you permit to access the Services — whether or not you were aware of that activity. You must keep your account credentials secure and notify us promptly if you suspect unauthorized access to your account or infrastructure.
You are solely responsible for maintaining your own backups of any data you store, process, or transmit using the Services. We do not warrant against data loss, and we have no obligation to back up your data on your behalf.
4. Acceptable Use Policy
We provide infrastructure, not content moderation — but we do not permit our network to be used to cause harm. You may not use the Services, and may not knowingly permit the Services to be used, for any of the activities below. This list is illustrative, not exhaustive: you are responsible for complying with all applicable laws wherever your content or messages are received, with particular attention to Hong Kong, where most of our customers and their audiences are based.

5. IP Address Allocation & Third-Party Terms
Some of the IP address space we assign to customers is registered directly to us; other ranges are leased from third-party IP address providers, or allocated to us by the data center(s) from which the Services are provided (data center-allocated, or "provider-assigned," IP address space). Where an IP address assigned to you falls within a leased or data center-allocated range, your use of that address is also subject to the relevant provider's own acceptable use policy and terms, in addition to this policy — we will advise you, on request, whether a given range is directly owned, leased, or data center-allocated. Continued misuse of such a range may result in us losing access to it, and we may reassign or reclaim the relevant addresses where necessary to remain compliant with that provider's terms.
6. Third-Party IaaS Services
As part of our IaaS Support services, we may assist you in provisioning, configuring, or managing infrastructure hosted by third-party cloud and IaaS providers. Where you use a third-party IaaS provider directly, your relationship with that provider — including its own terms of service, pricing, availability, security, and support — is a separate contract directly between you and that provider. We are not a party to that contract and accept no responsibility or liability for the third-party provider's services, including any outage, data loss, billing dispute, or policy violation on their platform.
Where we contract with a third-party provider on your behalf and resell or otherwise pass through that provider's services to you, your use remains subject to that provider's own terms of service and acceptable use policy. If we determine, in our discretion, that your use violates those third-party terms, we may suspend or restrict the affected service. Where the third-party provider itself suspends, restricts, or terminates the service — whether or not at our direction, and without prior notice to us or to you — we accept no responsibility or liability for that action or for any resulting loss.
In either case, our role is limited to the support services we provide to help you use that infrastructure.
7. Service Availability, Maintenance & Force Majeure
We may perform maintenance on the Services from time to time, on an irregular schedule. During maintenance, the Services may be temporarily unavailable, or may not function normally.
We will generally provide advance notice of scheduled maintenance where practicable. However, depending on the circumstances, notice may instead be provided after the maintenance has taken place.
The Services rely on upstream networks, transit and telecommunications providers, domain registrars, data centers, and other third-party facilities and services outside our control. Where an outage, failure, or maintenance event affecting any such upstream network, facility, or service impacts the Services, we accept no responsibility or liability for that impact.
We shall not be liable for any failure or delay in performance of the Services resulting from causes beyond our reasonable control, including acts of government or public authorities, war, riot, civil unrest, sabotage, embargo, fire, flood, or other natural disaster, strikes or other labor disputes, or delays in transportation.
8. Reporting Abuse
If you believe content or activity hosted on our infrastructure violates this policy, please report it to abuse@fangrandia.net with as much supporting detail as possible — URLs, IP addresses, timestamps, and message headers are especially helpful. We investigate all reports made in good faith.
Note that the abuse contact registered in the WHOIS record for a specific IP address or range may sometimes differ from the address above (see Section 5).
9. Investigation & Enforcement
We reserve the right to investigate suspected violations of this policy, which may include reviewing account activity and content hosted on our infrastructure to the extent reasonably necessary. Where we reasonably believe a violation has occurred, we may, at our discretion:
- Suspend or restrict access to the affected server(s)
- Remove or disable access to the offending content
- Terminate the Service agreement
- Report the matter to, and cooperate with, relevant law enforcement or regulatory authorities in Hong Kong or elsewhere
For serious violations — in particular child sexual abuse material, active attacks, or imminent harm — we may take action without prior notice.
10. Fees & No Refunds
Where we refuse to provide, suspend, or terminate the Services under Section 9 (Investigation & Enforcement), or where the Service agreement is otherwise terminated, any fees already paid for the then-current billing period, or for any prior period, are non-refundable, except where we agree otherwise in writing. You are deemed to waive any claim to a refund or credit of fees already paid, including for any unused portion of a prepaid period.
11. Your Services, Users & Liability
If you resell hosting, operate a platform, or otherwise permit third parties to use the Services, you are responsible for ensuring those third parties comply with this Acceptable Use Policy, and you remain responsible for any violation arising from their use of your infrastructure.
More broadly, we provide infrastructure only — we are not a party to, and take no responsibility for, any product, service, platform, or business you build or operate using the Services. Disputes, service interruptions, data loss, billing issues, or any other matter between you and your own customers, users, or partners are yours to manage; we have no liability in connection with them. You are solely responsible for the operation, security, and legal compliance of anything you run on the Services, and you agree to indemnify us against any claim arising from your use of the Services or from the services you operate on top of them.
12. Indemnification
You agree to indemnify and hold us harmless against all actions, claims, costs, losses, damages, and expenses arising out of or in connection with your use of the Services.
You further agree to indemnify and hold us harmless against all claims, actions, and costs, including legal fees, brought by any third party in connection with your use of the Services.
13. No Warranties
We make no warranties of any kind regarding the Services or your use of them, and we do not warrant the end-to-end bandwidth capacity or availability of the internet. To the fullest extent permitted by law, we exclude all implied warranties, including as to the quality of the Services and their fitness for any particular purpose. This section is subject to any warranty expressly given under an applicable Service Level Agreement.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, industry practice, or legal and regulatory requirements. The "Last Updated" date at the top of this page indicates when these Terms were last revised. Material changes will be communicated to active customers where practicable.
15. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong"). The parties submit any difference or dispute arising in connection with these Terms to the non-exclusive jurisdiction of the courts of Hong Kong. Regardless of where you or your users are located, you agree to comply with all applicable laws in connection with your use of the Services.
